Important Service Notice

Certain services depend on upstream infrastructure providers, platforms, data centers, registrars, cloud systems, email infrastructure providers, and network partners, including service providers located in the USA. Accordingly, service availability, technical parameters, pricing, policies, infrastructure, and related conditions may change at any time without prior notice due to reasons beyond our direct control.

All prices quoted at the time of subscription are indicative and based on prevailing USD to INR exchange rates, infrastructure costs, licensing costs, compliance costs, and charges imposed by upstream providers at that time. We reserve the right to revise, restructure, or increase pricing at any time, including during an active, prepaid, advance-paid, or locked-in term, if there is any increase in exchange rates, upstream provider costs, infrastructure charges, licensing costs, regulatory burdens, or any other material operating cost.

While reasonable commercial efforts may be made to provide notice of any such changes, failure to provide advance notice shall not by itself constitute a breach. Continued use of the Services after any revised pricing, policy, or condition has been communicated or published shall constitute acceptance of the same.

All services are provided strictly on an “AS IS” and “AS AVAILABLE” basis. The customer acknowledges that all website files, application files, databases, emails, attachments, backups, transmitted data, and other hosted or processed information are maintained entirely at the customer’s sole risk.

Backup and restoration services, where offered, are provided only on a best-effort basis and may be subject to additional charges. The Service Provider makes no guarantee regarding backup frequency, retention, completeness, recoverability, restoration success, or continued backup availability. The customer remains solely and exclusively responsible for maintaining complete, current, and independent backups of all website files, MySQL databases, emails, attachments, and any other data at all times.

To the maximum extent permitted by applicable law, the Service Provider, its directors, officers, employees, agents, affiliates, and partners shall not be liable, whether in contract, tort, negligence, strict liability, or otherwise, for any loss, deletion, destruction, alteration, corruption, inaccessibility, unauthorized access, hacking, malware event, ransomware incident, backup failure, downtime, service interruption, system failure, third-party failure, or data breach affecting any service, infrastructure, website, database, email account, or hosted data.

This exclusion shall apply irrespective of cause, including any error, omission, fault, service interruption, failure or inadequacy of backup systems, acts or omissions of third-party service providers, cyberattacks, malicious events, or any circumstance that is beyond our direct control. As certain services depend upon upstream providers in the USA and elsewhere, any changes, failures, disruptions, suspensions, discontinuation, policy changes, price escalations, technical limitations, or resulting data loss arising from such dependencies shall remain entirely outside our responsibility.

The customer acknowledges that the Service Provider does not undertake any obligation to provide long-term archival storage, guaranteed backup retention, guaranteed data recovery, or guaranteed restoration unless expressly agreed in a separate written agreement. The customer must regularly download, archive, and maintain independent copies of all data. Any failure to do so shall be solely at the customer’s own risk.
